1. Company information

These Terms and Conditions of Sale ("Terms") govern every purchase made on www.cadelnaso.com (the "Site"), operated by:

By placing an order on the Site, you accept these Terms in full. If you do not agree with them, please do not use the Site or place an order.

2. Products

2.1 Ca' del Naso sells wine produced by its own winery. Product descriptions, vintages, alcohol content and images on the Site are provided for information purposes; minor variations between vintages, labels or available stock and the images shown are possible and do not constitute a lack of conformity of the product.

2.2 Availability is subject to stock. If a product becomes unavailable after you place an order, we will inform you and offer a refund or a substitute of equivalent value, at your choice.

3. Age Verification and Responsible Sale of Alcohol

3.1 Our products contain alcohol and may only be purchased by, and will only be delivered to, individuals who have reached the legal drinking age in Italy (18) and in their country/place of residence and delivery, whichever is higher.

3.2 By placing an order you declare, under your own responsibility, that you meet this age requirement.

3.3 Our courier partners may require an adult signature. If no eligible person is available to receive the order, delivery may be delayed, re-attempted, or the order returned to us at your cost.

4. Orders

4.1 Product descriptions on the Site constitute an invitation to treat, not a binding offer. Your order constitutes an offer to purchase, which we are free to accept or decline (e.g., in case of stock unavailability, pricing errors, or failed age/delivery verification).

4.2 A contract is formed only when we send you an order confirmation email. We recommend you keep a copy of the order confirmation.

4.3 We may cancel or refuse orders that appear fraudulent, abusive, placed via automated means, or intended for resale without our consent.

5. Prices and Payment

5.1 Prices are shown in Euro (€) and, unless otherwise indicated, are inclusive of Italian VAT at the rate applicable at the time of the order. Shipping costs are shown separately at checkout, before you confirm your order, and are added to the total price.

5.2 For deliveries to the United States, the price shown at checkout is final and includes customs duties, import taxes, and customs clearance fees; you will not be charged any additional amount by customs or the courier upon delivery. For deliveries to other countries outside the European Union (and, where applicable, outside the EU customs/VAT area), unless otherwise stated at checkout, the price shown may not include import duties, taxes, or customs clearance fees, which remain the recipient's responsibility.

5.3 Payments are processed through Squarespace Payments and its payment partners. We do not receive or store your full card details; these are handled by Squarespace Payments in accordance with its own terms and applicable payment security standards (PCI-DSS).

6. Shipping and Delivery

6.1 We currently ship within Italy, the European Union, United Kingdom and United Sates. Shipping to US is free for orders over 300€. Available destinations are shown at checkout.

6.2 Orders are dispatched from our warehouse and delivered through third-party couriers. Estimated delivery times shown on the Site are indicative and not guaranteed.

6.3 Risk of loss or damage to the products passes to you upon delivery to you, or to a person you have authorised to receive the order, at the delivery address, in accordance with Article 63 of the Italian Consumer Code.

6.4 It is your responsibility to provide an accurate delivery address and to ensure a person of legal drinking age is available to receive and sign for the order. Additional delivery attempts, storage, or return-to-sender costs caused by an incorrect address or repeated failed deliveries may be charged to you.

6.5 International orders: you are solely responsible for verifying and complying with the laws of the destination country (and, where applicable, region/state) regarding the importation of alcoholic beverages, including any prohibitions, licensing requirements, quantity limits, minimum age requirements, and customs duties or taxes. We reserve the right not to ship, or to cancel an order, to jurisdictions where the sale or import of alcohol to consumers is restricted or where we are unable to verify compliance.

7. Right of Withdrawal (EU/Italian Consumers)

7.1 If you are a consumer residing in the European Union, you have the right to withdraw from the contract within 14 calendar days from the day you take physical possession of the products, without giving any reason.

7.2 To exercise this right, you must inform us of your decision by an unequivocal statement (e.g., a letter sent by post, PEC, or email to the contact details in Section 1) before the withdrawal period expires. You may, but are not obliged to, use the model withdrawal form in Annex A.

7.3 You must return the products, at your expense, to us without undue delay and in any event within 14 days of communicating your withdrawal, at your own cost, in their original condition, unopened, unused and with seals/labels intact. You are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature and characteristics.

7.4 We will reimburse all payments received from you, including standard delivery costs, within 14 days of being informed of your decision to withdraw, using the same payment method you used for the original transaction, unless otherwise agreed. We may withhold reimbursement until we have received the goods back, or evidence of their return, whichever is earlier.

7.5 The right of withdrawal does not apply, among other cases provided by law, to goods made to your specifications or clearly personalised, and to sealed goods that are not suitable for return for health or hygiene reasons if unsealed after delivery, to the extent applicable.

8. Legal Guarantee of Conformity

Products are covered by the legal guarantee of conformity under Articles 128–135 of the Italian Consumer Code, which applies for 24 months from delivery for consumers, provided the defect existed at the time of delivery and is reported within the legal time limits. If a product is defective or non-conforming, contact us at the details in Section 1 to arrange a remedy (repair, replacement, price reduction or termination, as applicable).

For any complaint, please contact us at info@cadelnaso.com. We will do our best to respond and resolve any issue promptly.

10. Intellectual Property

All content on the Site (text, graphics, logos, images, labels, and the Ca' del Naso trademarks and trade dress) is owned by or licensed to us and is protected by copyright, trademark, and other applicable laws. You may not reproduce, distribute, or otherwise use it without our prior written consent, except for personal, non-commercial use of the Site.

11. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for indirect or consequential losses arising from your use of the Site or purchase of products. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or defective products under mandatory consumer protection law.

12. Force Majeure

We shall not be liable for any delay or failure to perform our obligations resulting from causes beyond our reasonable control, including but not limited to natural disasters, strikes, transport disruptions, or acts of public authorities.

13. Changes to These Terms

We may update these Terms from time to time, in particular to reflect changes to shipping destinations, legal requirements, or our services. The Terms applicable to your order are those in force at the time you place it. Material changes will be indicated by an updated "last updated" date.

14. Governing Law and Jurisdiction

15.1 These Terms are governed by Italian law.

15.2 If you are a consumer, any mandatory consumer-protection provisions of the law of your country of habitual residence continue to apply, and you may bring proceedings before the courts of your place of residence, in accordance with applicable EU/Italian jurisdiction rules.

15.3 For business customers, the Court of Siena shall have exclusive jurisdiction.
